ALL WORKERS HAVE THE RIGHT TO:

 

Be protected by the employer from employment injury in the course of duty.

 

Take all reasonable and necessary precautions to ensure their own safety and the safety of their fellow employees.

 

Refuse to commence work by reason of unusual circumstances having arisen on the job that are hazardous or injurious to health or life.

 

Compensation for injury arising out of their employment.

 

A maximum six (6) weeks certified illness absence per annum for any illness, but up to six (6) months certified illness absence for employment injury or occupational illness.

 

A weekly rest from work for an uninterrupted duration of twenty-four (24) hours.

 

Be voluntarily unemployed, and not to be punished if they choose to be and remain unemployed.

 

Equality of treatment for national and foreign workers as regards workmen’s compensation for accidents.

 

Refrain from handling matches made with White or Yellow Phosphorous.

 

Clean work environment, adequate lighting and ventilation, sanitary convenience, drinking water, and protection from fires

EMPLOYERS MUST:

 

Discharge the duty of care owed at common law and by statute to his employees by ensuring that he provides competent fellow employees

 

Provide a safe working environment for all his employees to include safe plant, appliances and place of work, protective devices and a safe system of work.

 

Be liable to pay compensation in accordance with the provisions of the Workmen’s Compensation Ordinance if personal injury is caused to a workman by accident arising out of his employment.

 

Assume the role of “Principal” where, in the course of or for the purposes of his trade or business, the “Principal” retains a “Contractor”, for the execution of the whole or any part of any work undertaken by the “Principal”, whereupon, the principal shall be liable to pay to any workman employed in the execution of the work any compensation which he would have been liable to pay if that workman had been immediately employed by the “Principal.”

 

Take responsibility for injury to the public arising out of his commercial activity.

 

Ensure employees conform to workplace behaviour codes including private checks and searches of employees’ bags, divulging of information obtained at work, wearing of protective clothing or equipment, adherence to safety and maintenance regulation, and non-tolerance of the influence of alcohol or other non-prescribed drugs on employees while on duty.
